This scene was the re-enactment of the capture of John Dillinger and his associates who were arrested at various locations around Tucson, Arizona on the 25th January 1934.

According to the original reports, John Dillinger, Charles Makley, Harry Pierpont, Russell Clark and Edward Shouse had arrived in Tucson on the 21st January from Texas where they originally planned to cross the border at El Paso.

When they arrived, the gang checked into the Hotel Congress but while there, a fire had broken out in the hotel's basement forcing the gang to flee without their trunks, after realizing they left the trunks in the room, Clark and Makley gave the firemen $12 to go back up to the room to rescue their trunks.

A short time later, one of the firemen, William Benedict was sitting outside the local fire station, reading a True Detective magazine and had spotted photos of Makley, Pierpont and Shouse and had recognized them as the men who paid them the $12 for rescuing the trunks.

As Bendict read the article about the Dillinger Gang, he looked up and spotted one of the men from the article walking passing the fire station, leading Benedict to inform the local police.

The police traced the address on the trunks to a bungalow where Clark and later, Dillinger were arrested four days later on the 25th January after arriving.

Makley was also arrested the same day at the Grabbe Electric and Radio Store on Congress Street while shopping for a radio that picked up law enforcement channels.

Pierpont, Makley and Clark went sent back to Ohio for the murder of Sheriff Jess Sarber who was shot by Pierpont while busting out Dillinger from Allen County Jail in Lima, Ohio on the evening of the 12th October 1933, while Dillinger was sent back to Indiana for the murder of Officer William O'Malley who was shot by Dillinger during the robbery of the First National Bank in East Chicago, Indiana on the afternoon of the 15th January 1934.

Pierpont, Makley and Clark were convicted for the murder of Sheriff Sarber and were imprisoned at the Ohio State Prison in Columbus, Ohio.

Clark was sentenced to life imprisonment, he was later released on health grounds on the 14th August 1968 and died of cancer four months later on the 24th December 1968.

Makley and Pierpont were sentenced to death by the electric chair, on the 22nd September 1934, Makley and Pierpont, armed with two guns made out of soap bars and blacken with boot polish, had attempted to escape.

During the escape, Pierpont and Makley assaulted a guard and freed Clark from his cell, Clark then had second thoughts and headed back to his cell, while Pierpont and Makley were both shot by armed guards.

Makley was hit in the abdomen and chest and was killed, while Pierpont was hit several times but survived, he was later executed by the electric chair after midnight on the 17th October 1934.

Shouse who saw Dillinger and Clark being arrested, managed to get away without detection.
